These terms apply when you engage Fencing Company Birmingham - Installations and Repairs Contractor (“we”, “us”) for fencing installation, repairs, gates, or commercial and security fencing work. By accepting a written quote or instructing us to proceed, you (“the customer”, “you”) agree to these terms unless we agree different terms in writing.
1. Quotes and estimates
- Written quotes state the scope of work, materials, estimated duration and price. Verbal estimates are indicative only until confirmed in writing.
- Quotes are valid for the period stated on the quote document, or 30 days if no period is shown.
- Site conditions — including hidden obstructions, unsuitable ground, restricted access on terraced properties, or additional removal of existing fencing — may require a revised quote before work proceeds.
2. Acceptance and booking
Work is booked when you accept the written quote by email, message or other agreed confirmation. We schedule installation or repair dates after acceptance and subject to weather, material availability and existing commitments.
3. Customer responsibilities
- Provide safe access to the boundary and a clear working area where agreed.
- Confirm property boundaries and notify us of any known disputes with neighbours before work starts.
- Obtain any required planning permission or consent — including fence height limits (commonly up to 2 m at the rear and lower limits at the front in many locations). Compliance with planning and building regulations is your responsibility unless explicitly included in our quote.
- Locate and inform us of underground services (gas, electric, water) where known. We take reasonable care but are not liable for damage to unmarked or incorrectly marked services.
4. Materials and specification
We install materials as specified in the accepted quote — for example pressure-treated timber closeboard or feather edge, composite panels, gravel boards, concrete posts, or metal systems for commercial work. Substitutions of equivalent specification may be used if the stated product is unavailable, with your agreement.
5. Payment
- Payment terms are set out on your written quote (for example deposit before materials are ordered, balance on completion).
- Invoices are payable within the period stated on the invoice unless otherwise agreed.
- We may pause or stop work if agreed payments are not received when due.
6. Changes to scope
Additional work requested after acceptance — extra fence length, unforeseen ground preparation, removal of more old fencing than quoted — will be priced separately and confirmed before we carry it out.
7. Cancellation and postponement
If you cancel after materials have been ordered or a start date reserved, reasonable costs already incurred may be charged as stated in your quote or invoice. We will try to agree a revised date if you need to postpone; repeated postponements may affect scheduling priority.
8. Warranties and defects
We warrant that work is performed with reasonable skill and care. Manufacturing defects in materials are subject to supplier warranties where applicable. Report visible defects or concerns promptly after completion so we can inspect and, where appropriate, remedy issues covered by the quote.
Normal weathering, rot at ground level where maintenance is required, damage from third parties, storms or misuse are not covered unless expressly stated.
9. Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Subject to that, our total liability for any claim relating to a contract is limited to the amount paid by you for that contract. We are not liable for indirect or consequential loss (for example loss of profit) except where required by law.
10. Health and safety
We work in accordance with applicable health and safety requirements. Customers and others must keep clear of the work area during installation or repair.

12. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales unless mandatory consumer rights require otherwise.
